General Terms and Conditions Thai Café

Article 1 - Scope of Application
These general terms and conditions aim to govern the relationship between Thai Café restaurant and its customers in the context of the catering services offered on-site, for takeout, and delivery.
By placing an order in person at a restaurant, by phone, or online via our website or remotely through a delivery platform, the customer indicates that they accept these conditions without reservation.
It is possible to deviate from these conditions only if done in advance, in writing, and by explicitly stating the specific article targeted by this deviation, with the remaining provisions remaining fully in force.
Article 2 - Menu Items
Thai Café is a Belgian restaurant chain offering quality Thai cuisine. The uniqueness of Thai food comes not only from the ingredients used but also from the way they are prepared to offer an authentic Thai meal.
All menu items are subject to availability. We reserve the right to substitute or change ingredients based on market availability.
Article 3 - Allergies and Dietary Restrictions
The restaurant strives to accommodate requests regarding allergies and food intolerances. However, it is the customer's responsibility to inform the staff of any allergies or restrictions at the time of ordering in person at a restaurant, by phone, or online via our website or remotely through a delivery platform.
A list of allergens and food components of the offered dishes is available upon request at each Thai Café restaurant.
Allergens present in the products are also visible on the website in each product description, under a small "i" (info) icon.
We strive to keep this database complete and up-to-date, however, in case of severe allergies, the risks of traces that might be contained in by-products, as well as the risks of cross-contamination which are impossible to completely avoid in a restaurant kitchen, should not be underestimated.
The restaurant disclaims any responsibility in case of an allergic reaction if the information was not clearly communicated at the time of ordering.
Article 4 - Declaration of Personal Use
Products purchased in person at a restaurant or remotely through a delivery platform are intended for the personal use of the customer. Under no circumstances may the products be resold to third parties. No personal or commercial use may be made of the brand name or logo.
Article 5 - Hours and Reservations
Most of our restaurants are open from 12 PM to 11 PM every day.
However, some restaurants, particularly those located in shopping centers, may have different hours. It is always wise to check the exact hours of the restaurant of your choice.
Reservations can be made by directly contacting the restaurant of the concerned location by phone. In case of cancellation, we ask customers to inform us at least 2 hours before the reserved time.
Article 6 - Pricing and Payment
The prices listed on the menu are subject to change without notice. All orders must be paid for at the time of ordering. We accept cash, debit/credit cards, and certain mobile payment options. Payment delays may result in order cancellation.
Thai Café reserves the right to immediately pass on changes in cost prices, labor costs, or legal regulations to the catering offers.
All applicable prices always include VAT and other applicable taxes.
Article 7 - Takeout and Delivery Service
Customers are responsible for ensuring the accuracy of their order when picking up at the restaurant or upon delivery. The restaurant is not responsible for errors in the order once it has been picked up.
Delivery is available within a specific radius around the concerned restaurant, which is communicated on our website. Delivery fees may apply and will be specified at the time of ordering.
In case of delivery delay, no compensation is due. Thai Café is in no way responsible for delays in its delivery services or those of delivery platforms.
Article 8 - Use and Return of KioBox
Takeout and delivery orders are handed over to the customer in a reusable KioBox container (hereinafter "KioBox"). A deposit per provided KioBox is added to the total amount of the order.
By placing takeout and/or delivery orders at one of the Thai Café restaurants, the customer acknowledges having read the general terms and conditions of KioBox, which are accessible on the website www.kiobox.eu. The general terms and conditions of KioBox are deemed to be accepted without reservation by the customer upon completion of the order.
In case of contradiction between the general terms and conditions of KioBox and these conditions, the latter shall prevail, unless expressly stated otherwise.
Article 9 - Customer Responsibility
The customer must ensure that someone is available to receive the delivery at the specified address. The restaurant is not responsible for missed or unsuccessful delivery attempts due to incorrect address details provided by the customer.
Article 10 - Cancellation and Right of Withdrawal
Cancellation is distinguished from withdrawal in that the order has not yet been delivered.
Cancellations must be made as soon as possible and may be subject to fees depending on the time of cancellation.
The right of withdrawal does not apply to orders placed in person at one of our restaurants, by phone, or online via our website or remotely through a delivery platform.
Article 11 - Complaints and Claims
All complaints regarding takeout or delivered orders must be addressed the day following receipt, otherwise, all rights arising from them will be forfeited. Complaints must be directed to via the email address [email protected] specifying the nature of the complaints and preferably attaching a photo of the products in question. We commit to responding within five business days to complaints that meet the aforementioned conditions.
Thai Café reserves the right to replace the product in question, grant a voucher in one of our restaurants, or refund the invoiced value.
Article 12 - Behavior and Safety
We reserve the right to refuse entry or ask a customer to leave the premises in case of inappropriate behavior or lack of respect for other customers and staff. Any damage caused by a customer will be at their expense.
Our restaurants comply with all required health and safety regulations.
Article 13 - Intellectual Property Rights
Our websites, logos, trademarks, texts, photos, names, and, in general, our public communications, are protected by intellectual property rights either with us, our suppliers, or other rights holders.
It is forbidden to use and/or modify the intellectual property rights described in this article.
The customer is not authorized to copy or reproduce our designs, photos, names, menus, logos, color combinations, and any other media without our prior express and written permission. Any use without permission is prohibited.
Article 14 - Protection of Personal Data
The restaurant commits to respecting the confidentiality of personal information provided by customers. The collected data is used mainly for order and delivery management, in compliance with the European regulation on the protection of personal data (GDPR).
The data may also be used occasionally to communicate information and/or promotions from the restaurant to customers. The collected data may also be used to communicate investment opportunities within the Thai Café group. The restaurant commits to never selling the collected data to third parties for any purpose.

Article 15 - Force Majeure
By force majeure, we mean an event independent of Thai Café's will, which does not fall under its responsibility according to the law, a legal act, or generally accepted opinions.
The restaurant cannot be held responsible in case of delay or cancellation of service due to events beyond its control, such as natural disasters, strikes, floods, special weather conditions, epidemics, or technical problems affecting the services.
In case of force majeure, Thai Café reserves the right to suspend the execution of any order or to dissolve it without judicial intervention, by notifying the customer in writing or by phone, and without the restaurant being liable for any compensation.
Art. 16 - Liability
We disclaim any liability except in case of gross negligence or intentional fault. We are also not liable for direct or indirect damages for which we have not expressly provided our liability in these conditions. Thai Café is not responsible:
- For actions and/or omissions of third parties.
- For misunderstandings, delays, or inappropriate transmission of orders, and
- For communications resulting from the use of the internet or any other means of communication in the traffic between the customer and Thai Café.
Our liability will, in any case, be limited to the amount of the price set for that order (excluding VAT). In any event, it excludes at all times damages against which the customer is already insured.
We do everything to ensure that the website is accessible 24 hours a day, 7 days a week. Given the technical characteristics of the internet and computer tools and the need to periodically perform maintenance, updates, or upgrades, we cannot, however, guarantee uninterrupted access and service provision. In case of interruption or disruption normally acceptable for access or service provision, we do everything to resolve it as quickly as possible.
Article 17 - Modification of the General Terms and Conditions
The restaurant reserves the right to modify these general terms and conditions at any time. Modifications will take effect upon their publication on our website or in the restaurant. The last update was made in April 2025.
Article 18 - Jurisdiction and Applicable Law
All disputes relating to our offers and/or contracts or arising from them are governed by Belgian law. In case of dispute or contestation, only the courts of the district of our registered office will have jurisdiction.
